1. Scope

These terms apply to distance purchases of the products presented on obimarketproducts.com (the “Website”) by consumers, meaning natural persons acting for purposes outside their trade, business or profession.

Each product is presented on a dedicated page (the “Offer”), which sets out the specific conditions of that sale: price, countries of delivery, payment methods, delivery times and costs. Where the Offer differs from these general terms, the Offer prevails, without prejudice to the rights granted to consumers by law.

2. Identity of the parties

The seller of each product (the “Seller”) is the party identified on the Offer page, with its name, geographical address and contact details, before the customer submits an order. The same details are included in the contract confirmation. Towards the customer, the Seller is the party bound by the legal obligations applicable to distance sales, including those relating to the right of withdrawal and the legal guarantee of conformity.

3. Products and information

The main characteristics of each product are described on the Offer page. Images and illustrations are for guidance only. If a product is no longer available after an order has been placed, the customer is informed without undue delay and any amount already paid is refunded.

4. Prices

The total price of the product, including taxes, and any delivery charges or other costs are shown on the Offer page before the order is submitted. The customer will not be charged any costs that were not communicated before the order.

5. Orders and conclusion of the contract

The customer submits an order request by completing the form on the Offer page. Submitting the form is a request and does not in itself conclude the contract, which is concluded in the manner indicated in the Offer and in accordance with the consumer protection rules on distance contracts (Directive 2011/83/EU and the national laws implementing it).

Before being bound, the customer receives, in a clear and comprehensible manner, the pre-contractual information required by law, including the identity of the Seller, the main characteristics of the product, the total price, payment and delivery arrangements and the conditions of the right of withdrawal.

The Seller provides the customer with confirmation of the concluded contract on a durable medium within a reasonable time and at the latest at the time of delivery. The confirmation includes information on the right of withdrawal and the model withdrawal form.

Where national law provides that a contract concluded by telephone binds the consumer only after the consumer has signed the offer or accepted it in writing (for example, Article 51(6) of the Italian Consumer Code), the contract is binding on the consumer only after such acceptance.

6. Payment

The available payment methods and any additional costs are shown on the Offer page and confirmed in the order summary. No fees for the use of a means of payment are charged in excess of the cost borne by the Seller.

7. Delivery

Countries served, delivery times and delivery costs are shown on the Offer page. Unless another period is indicated, delivery takes place within 30 days of the conclusion of the contract. The risk of loss of or damage to the products passes to the customer only when they take physical possession of the products. See our Shipping Policy for details.

8. Right of withdrawal

Consumers may withdraw from the contract within 14 days of delivery, without giving any reason and without penalty, including for products bought on promotion. The procedure, deadlines and refunds are described in our Refund Policy, which includes the model withdrawal form.

9. Legal guarantee of conformity

All products are covered by the legal guarantee of conformity provided by Directive (EU) 2019/771 and the national laws of the consumer’s country of residence, for defects that become apparent within two years of delivery. The consumer is entitled to have the product brought into conformity by repair or replacement free of charge and, where provided by law, to a price reduction or termination of the contract. Any additional commercial guarantee, where offered, is indicated in the Offer and does not limit the legal guarantee.

10. Customer support and complaints

For support, reports and complaints, email info@obimarketproducts.com, including your name and order details. Consumers may also contact the authorities and dispute resolution bodies available in their country.

11. Applicable law and jurisdiction

Consumers always retain the protection of the mandatory provisions of the law of the country where they have their habitual residence. Consumers may bring proceedings before the courts of their place of residence or domicile.

13. Changes

The terms that apply are those published on the Website at the time the customer submits the order.
